Peggle Art Contest Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ENTRIES WILL BE JUDGED IN TWO AGE GROUPS: ADULTS (AGES 18+); AND YOUTH (AGES 13 - 17). Participation in the Peggle Art Contest (the "Contest") is open to legal residents of the 50 United States and Washington, D.C. who are 13 years of age or older as of March 3, 2009. See Rule 6, below, for further eligibility requirements/restrictions. If you are considered to be a minor in your state of residence, then participation in this Contest requires prior parental approval. The Contest is void outside the 50 United States and D.C. and where prohibited by applicable federal, state, or local laws, rules or regulations. Be sure to read all eligibility requirements carefully. DO NOT ENTER THIS CONTEST IF YOU DO NOT MEET ALL ELIGIBILITY REQUIREMENTS.
  1. How to Enter: The Contest is sponsored by PopCap Games (the "Sponsor"). Contest begins March 3, 2009 at 12:00:01 AM Pacific Time ("PT") and ends on June 3, 2009 at 11:59:59 PM PT (the "Contest Period"). Two ways to enter: a) Online; or b) By mail. a) To enter online, go to www.popcap.com/promos/peggleart (the "Web Site") and click on the Contest link to access the online entry form. To enter, a participant ("Participant") must:

  2. Send submission file and completed entry form file with all the required information via email to peggleart@popcap.comand include the following:


  3. Date of Submission

  4. Description of Submission. The description should be a 50 word or less explanation about the art image you have created, or the idea you have created for an art image. Description should outline how the contestant sees the art/proposed art being used in the game if it was picked as a winner. (See Rule 2, below, for further details.) User name and contact information ;and

  5. Actual submission in approved format.(See Submission Requirements, below)

  6. Send via email to the address noted in i, above, as file attachments, your competed entry form file and your original creation file ("Submission") that meets all of the Submission Requirements (as set forth below) and Contest Restrictions (as set forth below); AND, if Participant is a minor

  7. Enter a parent's or legal guardian's email address on entry form when entering. Parent or legal guardian will receive an email from the Sponsor informing the parent/guardian of your Submission and your desire to participate in this Contest and giving the parent or legal guardian the opportunity to view your Submission and approve your participation in the Contest and agree to be bound by the Official Rules. If your parent/legal guardian does not notify the Sponsor of his/her approval of your Submission and participation in the Contest, and/or does not agree to be bound by the Official Rules, then your Submission will be disqualified and you will not be entered in the Contest.

  8. All online entries and parental consent (if applicable) must be received by 11:59:59 PM PT on June 3, 2009. The computer clock of the PopCap.com office in Seattle, WA is the official time keeping device of the Contest.

  9. To enter by mail, go to www.popcap.com/promos/peggleart (the "Web Site") for entry instructions. To enter by mail, a participant must: .

  10. Download, print out and complete the entry form by providing the information required; AND

  11. In an appropriate envelope or other mailer, enclose the completed entry form along with your Submission that meets all of the Submission Requirements (as set forth below) and Contest Restrictions (as set forth below); AND, if Participant is a minor

  12. Download, print out and have your parent or legal guardian complete the "parental permission form" found on the Web Site with all required information, including your parent's/legal guardian's telephone number and email address, and include the permission form in the envelope/mailer along with your entry form and Submission. Parent or legal guardian will receive a phone call or an email from the Sponsor, informing the parent/guardian of your Submission and your desire to participate in this Contest and giving the parent or legal guardian the opportunity to approve your participation in the Contest and agree to be bound by the Official Rules. If your parent/legal guardian does not notify the Sponsor of his/her approval of your Submission and participation in the Contest, and/or does not agree to be bound by the Official Rules, then your Submission will be disqualified and you will not be entered in the Contest; AND (whether a minor or adult)

  13. Mail your entry, with proper postage affixed, to: Peggle Art Contest C/o PopCap Games. 2401 4th Ave SUITE 810, Seattle, WA 98121. All mailed entries must be received by June 3, 2009.

  14. For all Participants, online and mail-in alike: If your Submission includes any identifiable person besides Participant who is named or who can be seen or heard (each a "Third-Party Participant"), you must download from the Web Site and print out a "Third-Party Release", have it completed and signed by each such third-party (or his/her parent or legal guardian if the third party is a minor) and be prepared to submit it to Sponsor upon request at any time during or after the Contest Period.

  15. Upon satisfactory completion of the above (and upon receipt of approval by your parent or legal guardian if you are a minor), you will be entered in the Contest and your Submission and the information you submitted to enter will be referred to collectively as your "Entry". Sponsor may, but is not obligated to, post your Entry on the Web Site at any time during the Contest Period. Sponsor reserves the right to review and void any Submission it feels in its sole discretion does not comply with these Official Rules or that would be considered to be offensive to the viewing public or damaging to the PopCap Games brands. Sponsor may so void any Submission at any time during the Contest Period, even if it has previously been posted on the Web Site. Limit one (1) Entry per person for the entire Contest Period. There may be only one (1) named Participant for each Entry submitted. Multiple submissions of the same Entry by members of the Participant's household or by anyone other than the original Participant, will be disqualified. All entries must be submitted online or by mail in accordance with these Rules; No other method of entry will be permitted.

  16. Submission Requirements: What we are looking for: Any artwork or design ideas related to either of the Peggle games is considered an acceptable Submission provided it complies with all requirements of these Official Rules. Entries can involve any aspect of the game's artistic elements, from background scenes and drawn or written descriptions of new Peggle Masters and power-ups to level designs or Peg layouts. 2 Examples would be the following:

  17. New Peggle Master/Power-Up: Draw or describe your idea for a new "power-up" for Peggle - a new effect or power triggered by the magical green pegs. You may but are not required to provide a character to whom the power would belong. If you can draw, go right ahead - if not, just write out your description. Color is not required for drawings and basic black and white sketches are acceptable as entries

  18. Level Design: Draw or design your vision for the ideal Peggle level layout... put the pegs or bricks wherever you want, so long as there are a total of 25 orange pegs/bricks. Add any other obstacles, elements or objects as appropriate. If you wish to show some movement or animation, submissions can include additional pages to show how the level would change or alter using game mechanics The descriptions above are intended as examples only.

  19. Submission must be the original work of the Participant. The Submission may feature/include a representation or image of PopCap Peggle branding, logos or art. The inclusion of PopCap Peggle branding, logos or art in a Submission will not, alone, influence the judging described herein. PopCap Limited License: You may use the PopCap Peggle branding, logos or art for purposes of this Contest only.

  20. No Infringement: The content of the Submission must not infringe third party rights by including, for example, the copyrights, trademarks or logos (such as company names, labels or symbols other than those of PopCap Peggle) music, photographs, works of art, or images that have been created, distributed, aired or published by others, such as those on or in websites, television, movies, or other media outlets. No names, photos and/or likenesses of any person other than Participant may be included in the Submission without first obtaining permission from such person or his/her parent or legal guardian (as appropriate), and the Submission may not refer to public figures, contain materials embodying the names, likenesses, photographs or other identifying elements of any person, living, or dead, without appropriate prior permission.

  21. For online Participants: Participants who enter online are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit a Submission. Submission is subject to and must meet and abide by all Official Rules as well as the requirements set forth below or it will be disqualified. Online Participants must email their Submissions to peggleart@popcap.com as described more fully above. In addition to the requirements noted in A., B. and C. Submissions must comply with the following requirements: a. Submission must be in one of the following file formats: JPEG, GIF, TIFF, PNG, PDF, DOC, PPT or TXT b. Submission may not exceed a file size larger than 5MBS; c. Submission must be in the English language (if it contains any written or vocal component); d. Submission must be the Participant's original creation, unpublished, the sole property of Participant, and not previously submitted in any other contest. Modifying, enhancing or altering a third party's preexisting work does not qualify as a Participant's original creation. D. For mail-on Participants: Mail-in Participants must mail their Submissions (as described more fully above) to: Peggle Art Contest C/o PopCap Games. 2401 4th Ave SUITE 810, Seattle, WA 98121 Submissions must comply with the following requirements: a. Submission may not be larger than 8.5" X 11" X 4"; b. Submission may not contain hazardous materials, including but not limited to uranium-based paint; c. Submission must be in the English language (if it contains any written component); and d. Submission must be the Participant's original creation, unpublished, the sole property of Participant, and not previously submitted in any other contest. Modifying, enhancing or altering a third party's preexisting work does not qualify as a Participant's original creation. E. Secure Authorizations From All Identifiable Persons in Submission. By entering, a Participant (or his/her parent or legal guardian if Participant is a minor) represents and warrants that s/he has obtained written permission and all other necessary authorizations from any Third Party Participant allowing use of such person's name, likeness or voice in the Submission, and each Participant and Third Party Participant (or such Third Party Participant's parent/legal guardian if Third Party Participant is a minor) agree to and do hereby assign all rights for usage to Sponsor. Participant, or his/her parent or legal guardian (if applicable) may be required, at any time, to provide Sponsor with evidence of all such releases, assignments, written permission(s) and authorization(s). Third Party Participants must be of legal age of majority in the jurisdiction where they reside, unless a release has been executed by the parent or guardian of such Third Party Participant. The Participant, or his/her parent or legal guardian (if applicable) will be required to provide evidence of all such releases, assignments, written permission(s) and authorization(s) immediately upon request by Sponsor. If in its sole discretion Sponsor elects to accept any Submission, Participant (or his/her parent/legal guardian, if appropriate) hereby represents and warrants (i) that s/he agrees to assign any rights s/he or the Participant if a minor may have in and to the Submission to Sponsor, and forever releases and holds Sponsor harmless from and against any liability of any kind arising from or in connection with the use of the Submission, and (ii) that s/he, for him/herself (and for the Participant if a minor), agrees to be bound by these Official Rules. F. Sponsor and/or its designees reserve the right not to accept any Submission in its/their sole discretion. G. By entering, (or by giving permission to enter in the case of minors), Participant/Participant's parent or legal guardian (as applicable) agrees that Participant's submission is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, and that Sponsor is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to Participant. Participant/Participant's parent or legal guardian (as applicable) acknowledges that, by acceptance of Participant's Submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Participant. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants. By submitting or approving a Submission, Participant/Participant's parent or legal guardian (as applicable) acknowledges that Sponsor has no obligation other than those contained in these Official Rules to accept or post such Submission. H. By entering, (or by giving permission to enter in the case of minors), Participant/Participant's parent or legal guardian (as applicable) warrants and represent that the Participant has not included any restricted content (see list of Content Restrictions below) in any Submission and has not violated any of the Submission requirements (see list of such Requirements above) with respect to such Submission.

  22. I. Content Restrictions: Content Restrictions include but are not limited to the following:

  23. content providing personally identifiable information about Participant or Third Party Participants, such as last name, address, phone number or any contact information;

  24. content in violation of third party rights including, but not limited to: copyrights, including copyrighted music, trademark, right of publicity or any other proprietary rights;

  25. content portraying libelous, defamatory, disparaging, tortuous or slanderous materials;

  26. content portraying pornography, adult-oriented content or any other sexually-explicit material;

  27. content portraying lotteries or gambling;

  28. content portraying explicit or offensive language or content;

  29. content portraying violence;

  30. content portraying imitations of people or characters from movie/shows, etc.;

  31. content portraying discrimination;

  32. content portraying promotion of illegal activities;

  33. content portraying tobacco, alcohol or drugs;

  34. content portraying dangerous stunts;

  35. content portraying over consumption of food and/or beverages;

  36. content portraying weapons of any kind including, but not limited to, guns, bombs, or knives;

  37. content portraying material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any basis protected by federal, state, or local law, ordinance, or regulation;

  38. content that denigrates, disparages or reflects negatively on the Sponsor, or its products or its employees, or any other person, company, product or service or that disparages Sponsor's competitors;

  39. audio and/or visual content owned by any third party; and

  40. material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created. If a Submission or Entry includes any of the prohibited elements listed above, the Submission/Entry will be disqualified, along with the Participant who submitted it. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual license and right to publish, use, edit, adapt and/or modify the Entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without limitation and without notice or consideration to the Participant. By submitting an Entry, each Participant/Participant's parent or legal guardian (as applicable) further agrees that such entry constitutes an assignment of all rights, including but not limited to intellectual property rights, and title in and to such Entry to Sponsor. Sponsor may require Participant/Participant's parent or legal guardian (as applicable) to execute documents to confirm this transfer of rights. Failure to do so may result in disqualification. Sponsor shall have the right, but not the obligation, to disclose any Submission to other persons and organizations, including without limitation, legal authorities.

  41. Judging of Entries: Entries will be judged within each age group. Therefore, all Entries submitted by Participants who are 13 - 17 years of age will be judged against each other, and all Entries submitted by Participants who are 18+ years of age will be judged against each other. Entries will be judged, per the structure described above, in two phases:

  42. Phase 1:

  43. Qualified judges from within the PopCap Games company will judge the entries on the basis of the following criteria: Creativity (33%); Playability (Fun Factor) (33%); and Feasibility (The potential for the Submission to actually be incorporated into Peggle) (34%) On the basis of the judging in Phase 1, the top 20% of the Entries received in each age group for each category will be declared "finalists" and will proceed to Phase 2 of the judging process.

  44. Phase 2:

  45. A second panel of qualified judges from PopCap Peggle will judge the finalists on the basis of the same criteria used in Phase 1 judging. On the basis of the judging in Phase 2, one (1) Grand Prize winner, one (1) Semi-Finalist and ten (10) Runners-up will be chosen per age group. In the event of a tie in either Phase of judging, the tied Entry with the highest score in the Feasibility criterion will be deemed the finalist/ winner/Semi-Finalist/Runner-Up, as applicable.

  46. Phase 1 judging process will begin on or about March 10th 2009 and will conclude on June 5th 2009. Phase 2 judging will take place on or about June 6th, 2009.

  47. All Entries are subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules before any prize will be awarded.

  48. 4. Prizes:

  49. Two (2) Grand Prizes (one (1) per age group): Each Grand Prize winner will receive all of the following:

  50. Possible inclusion (at Sponsor's sole discretion) of their Submission or a derivative thereof in a future installment in Peggle series.

  51. Trip for two (winner and one guest) to Seattle, WA from July 19, 2009 through July 21, 2009. Trip includes round-trip, coach class air transportation to Seattle, WA from the major airport nearest winner's home (as determined by Sponsor), double-occupancy hotel accommodations, ground transportation while in Seattle, meals of Sponsor's choice and a tour of the PopCap offices. For winner(s) in Youth age group, a parent or legal guardian must accompany winner as his/her guest on trip.

  52. $500 Shopping Spree at Best Buy (Awarded as a $500 gift card)

  53. iPhone or Xbox w/PopCap games included

  54. Peggle and Peggle Nights signed boxed editions

  55. Peggle pins, coffee mugs, t-shirts, 'trading cards' of Sponsor's choice Approximate Retail Value (ARV) of Grand Prize package: $2,200.

  56. Winner and guest must travel together on same itinerary. The actual retail value of the Grand Prize may vary, depending upon the city of departure and any fluctuations in airfare, and any difference between the stated and the actual retail value of the Grand Prize will not be awarded.

  57. Travel/accommodations restrictions may apply. Notwithstanding anything contained above, air transportation will not be provided as part of the Grand Prize if the Grand Prize winner resides within one hundred (100) miles of Seattle, WA. If the Grand Prize winner does reside within one hundred (100) miles of Seattle, WA., then in lieu of air transportation, he/she will receive use of a rental car (subject to any and all age and/or other eligibility restrictions that may apply, and not inclusive of gas or any optional insurance coverage), in a size/class and model to be determined by Sponsor (in its sole discretion); no other alternative form(s) of transportation, and no compensation of any kind or amount (e.g., for the difference in value between the air transportations and the rental car) will be provided to the Grand Prize winner. Prize must be accepted in the manner described herein; otherwise, (a) the potential Grand Prize winner will forfeit all rights to receive and use the Grand Prize (and all components thereof); (b) Sponsor shall be relieved of any and all further obligations or liability to such potential Grand Prize winner; and (c) Sponsor shall have the right (but not the obligation) to select an alternate potential Grand Prize winner on the basis of the judging results in the appropriate age group. The Grand Prize trip may not be combined with any other offer(s), and travel may not qualify for frequent flyer miles. All travel arrangements must be made through Sponsor's agent.

  58. Two (2) Semi-Finalist Prizes (one (1) per age group): Each Semi-Finalist will receive the following:

  67. Each winner is responsible for any and all costs not specified above as being included in the prize. Use of gift card is subject to all policies, terms and conditions of the issuing party.

  68. No prize substitutions or transfers allowed except as provided herein. Sponsor may substitute a prize (or prize component) of equal or greater value if an advertised prize (or component thereof) becomes unavailable.

  69. 5. Winner Notification: On or about July 15th 2009 , the Sponsor will notify the Participant (or his/her parent or legal guardian if a minor) by email, telephone and/or postal mail. The Participant (or his/her parent or legal guardian if a minor) will be required to sign and properly execute an assignment of rights in and to the Submission, an affidavit of eligibility, liability waiver, and where legal, consent to publicity about said Participant, and provide evidence of Third Party Participant assignments and releases (in the language and format provided via e-mail by Sponsor) and return all required documents within five (5) days of first written notification or the Potential prize winner may be disqualified and the prize may be awarded to the Participant whose Entry received the next highest score in the appropriate age group in the Phase 2 judging.

  70. If a prize is not claimed in accordance with these Official Rules, or if any prize notification or documentation is returned as undeliverable, or if the Participant (or his/her parent or legal guardian, as applicable) fails to properly execute and return all required documents described herein, the corresponding prize will be forfeited and awarded to the Participant whose Entry received the next highest score in the appropriate age group in the Phase 2 judging. Sponsor reserves all rights, including the right to edit, publish, use, adapt, or modify the content of any Entries, whether winning Entries or not, for advertising and promotional purposes in commerce and in all media worldwide (including and without limitation, the Internet) without limitation, approval or additional notice or compensation, except where prohibited by law.

  71. 6. Exclusions from Participation. The following persons are NOT eligible to participate or win in the Contest: Employees, officers and directors of Sponsor, its parent company, affiliates, subsidiaries, related companies, suppliers, agents and retailers, advertising and promotion agencies, anyone involved in the creation, execution or fulfillment of this Contest, and members of the immediate families (defined as parents, siblings, children and spouse, and their respective spouses, regardless of where they reside) and/or households (whether related or not) of any of the above.

  72. 7. General: Participation constitutes Participant's (or his/her parent's/guardian's) full and unconditional agreement to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest. Participants will be disqualified if they, or their parents/guardians (as applicable), fail to abide by these Official Rules. Participants or Parents/guardians of Participants (as applicable) in the Contest assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to Sponsor and agree that any prize awarded is awarded upon the condition that Sponsor, its promotion/advertising agencies, suppliers of Contest materials, their respective parent companies, affiliates and subsidiaries, and the officers, directors, partners, principals, partnerships, employees and agents of each of the foregoing, shall have no liability whatsoever for, and shall be held harmless from and against, any injuries, losses or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of a prize, or participation in this Contest or participation in any Contest-related or prize-related activities, and further acknowledge that said parties, to the extent allowed by law, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. As a condition of entering, Participants or Parents/guardians of Participants (as applicable) agree that (1) under no circumstances will Participant or his/her parent/guardian (as applicable) be permitted to obtain awards for, and Participant and his/her parent/guardian (as applicable) hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (2) the Contest will be administered in the State of Washington and all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action and shall be brought in a court of competent jurisdiction in the State of Washington applying Washington law; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees.

  73. Sponsor, its parent company, subsidiaries, promotions agencies, printer, suppliers of promotional materials and any of their respective affiliates, and the officers, directors, partners, principals, partnerships, employees and agents of each of the foregoing, are not responsible for typographical errors, security, technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud by any Entrant, incomplete, garbled or delayed computer transmissions, or un-delivered, lost, late, damaged, misdirected, incomplete, postage-due or illegible mail/email whether caused by Sponsor, Participant or by any of the equipment or programming associated with or utilized in the Contest or by technical or human error which may occur and/or which may damage a user's computer system or limit a Participant's ability to participate in the Contest and/or receive the prize in the Contest or any virus, bugs, non-authorized human intervention or other causes that may corrupt or impair the administration, prize claim, security, fairness or proper play of the Contest (including but not limited to attempts to hack into or otherwise tamper with underlying source code/programming of the Contest). By accepting a prize, each winner (or winner's parent/guardian) agrees that Sponsor may use winner's name, likeness, photograph and/or limited biographical information, without limitation, for promotional purposes without further consideration or payment, except where prohibited by law.

  74. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest should (in the Sponsor's opinion) human error, virus, bugs, non-authorized human intervention, fraud or any other causes corrupt or affect the administration, security, fairness, publicity, or proper conduct of the Contest. In such case, the Judges will select the winners from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor based on the judging criteria stated herein. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds (in the Sponsor's opinion), to be tampering with the entry process or the operation of the Contest or Web Site. Sponsor may prohibit a Participant from participating in the Contest or winning a prize if it determines (in the Sponsor's opinion) that said Participant is attempting or has attempted to undermine the legitimate operation of the Contest by cheating, hacking, fraud, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other persons or entities, including without limitation, Sponsor, any other Entrants or Sponsor representatives.
